Compliance and safety: the non-negotiables

Goal: After this lesson you can identify where compliance requirements come from, act correctly on safety violations, and plan new regulations into the project.

1The situation

“Only ten more minutes”

During a site walk, you see a subcontractor's crew working at height on the robot cell mezzanine without fall protection. The supervisor says: “It's just ten more minutes. The harnesses are in the van.”

The same week, a safety audit finds that temporary guarding around a partly commissioned cell doesn't meet the standard. Fixing it will delay a customer demonstration and trigger a contractual penalty.

And a new provincial regulation adds functional-safety documentation for all machines commissioned after December.

Three compliance questions. On the PMP, the answer to all three is the same in spirit: compliance and safety come first.

2Where compliance comes from

Compliance requirements come from laws and regulations, standards, contracts and company policy. They are constraints, not options.

Safety
First
Immediate danger → stop the work now.
Legal
Not negotiable
No trading compliance against schedule, cost or relationships.
Change
New rules
Assess impact and plan compliance through change control.
PMP mindset: never operate, ship or demonstrate with a known safety or legal non-compliance. Manage the commercial consequences transparently instead.

3Sources of compliance requirements

Laws & regulations

Occupational safety, machine safety, environmental, export control, labour law.

Standards

Industry and safety standards referenced by law or contract.

Contract

Customer policies and requirements written into the contract.

Organisation

Company policies: safety, quality, procurement, ethics.
Laws, standards, contracts and policies all create requirements.

4How it looks on the exam

Exam-style question 1. An internal safety audit finds that temporary guarding around a partly commissioned robot cell does not meet the safety standard. Fixing it will take two days and delay a customer demonstration, triggering liquidated damages. The site manager suggests running the demonstration first. What should the project manager do?
A. Run the demonstration under close supervision, then fix the guarding
B. Correct the guarding before any further operation, inform the customer of the delay and cause, and handle the contractual consequences properly
C. Ask the customer to sign a safety waiver
D. Escalate to the sponsor and proceed if approved
